Nevada requires a permit for all legend drugs, not only controlled substances, and extends the same route to mid-level providers on their own applications.
Dispensing permit
Physicians and other practitioners may dispense medications to their patients as long as they comply with all state and federal laws, complete the Application for Authority to Dispense Drugs from the Nevada Board of Pharmacy, and receive a dispensing permit.
This permit is required for all legend drugs, controlled and non-controlled alike. Nevada does not offer a non-controlled tier that a practice can start on without a permit, so the application is the first step regardless of intended formulary.
Mid-level providers
Advanced Practice Registered Nurses (APRNs) and Physician Assistants (PAs) may also dispense, and have a separate application to complete. The fees for the physician dispensing permit, Advanced Practitioner of Nursing dispensing permit, and Physician Assistant dispensing permit are all currently $300.
Because each provider holds an individual permit rather than working under the physician’s, a practice adding mid-level dispensers should budget a separate $300 application for each one and allow time for each to be approved.
As always, all state and federal regulations must be followed when dispensing, including drug storage and labeling requirements.
PMP reporting
Dispensers must report controlled substance dispensing no later than the end of the next business day after dispensing.
Nevada’s reportable scope is worth confirming against your formulary. Pharmacies and dispensing practitioners report Schedule V controlled substances in addition to Schedules II through IV, so a formulary that includes lower-schedule products still carries the obligation.
Where a dispenser has dispensed no controlled substances during the reporting period, a zero report transmission is required rather than simply sending nothing.
